Variance Application

A Variance is a request to vary or change a specific requirement of the RM of Headingley Zoning By-law for a particular property. This may include requirements such as setbacks, lot coverage, building height, parking, signage, or other zoning regulations.

A Variance does not change the zoning of a property or add a new use. It only provides relief from a specific zoning requirement where approval is granted.

When Do I Need a Variance?

You may need a Variance if your proposed development does not meet one or more requirements of the Zoning By-law.

Common examples may include reducing a required setback, increasing maximum lot coverage, increasing permitted building height, reducing parking requirements, or varying other site-specific zoning standards.

Applicants are encouraged to confirm the zoning requirements for their property before submitting an application.

Variances in New Developments

The RM of Headingley generally does not generally support variances in new greenfield developments, including areas such as Taylor Farm, Blumberg Park, and Forest Grove.

These developments are planned with established lot sizes, building envelopes, servicing layouts, drainage patterns, and neighbourhood design standards. Applicants are expected to design their project to comply with the requirements of the Zoning By-law.

Setback variance requests in these areas are unlikely to be supported unless there are unique site-specific circumstances that clearly justify the request.

How to Apply

A complete Variance application must include:

  • Completed Variance Application Form
  • Detailed site plan
  • Detailed letter of intent
  • Status of Title, dated within 30 days
  • Application fee: $700.00
  • Any additional information requested as part of the application review process

Incomplete applications may be delayed or returned for revision.

Public Hearing Process

Variance applications generally require review and approval by Council through a public hearing process.

As part of the public hearing process, notice is mailed to all property owners within 100 metres of the subject property. Notice is also posted at the Municipal Office, Headingley Community Centre, and Municipal Library.

At the public hearing, Council may consider:

  • The nature of the requested variance
  • Whether the proposal is compatible with the surrounding area
  • Potential impacts on neighbouring properties
  • Site layout, access, parking, servicing, drainage, and other planning matters
  • Comments from nearby property owners or affected agencies

Council may approve the application, approve it with conditions, or deny the application. If approved, the applicant must comply with any conditions imposed under Section 98 of The Planning Act

Important Note

A Variance approval only applies to the specific request approved by Council. Any future changes to the proposal may require further review, permits, or additional approvals.
